Removal and Post-Decree Modifications Lawyer
The Law Offices of Douglas B. Warlick protects the rights of clients in court when one parent is requesting a change in custody, visitation, child support, alimony/maintenance, or residency of children. Because the judge has a fair amount of latitude in these cases, it is extremely important to have quality legal counsel.
Doug Warlick offers 25 years of experience in the practice of law in Illinois. His practice is devoted exclusively to family law and divorce, and he has resolved every type of legal issue relating to post-decree modifications, including parents who were divorced and those who were never married. Located in Geneva, Illinois, the firm serves parents in Kane County and DuPage County.
Child Support
Either parent may sue in Illinois for modification of child support. In general, the court requires a substantial change in circumstances to alter the amount of child support. If you have lost a job (assuming it was not voluntary impoverishment), we can represent you in petitioning the court for a lowering of your monthly obligations. Likewise, if you believe the other parent’s income is substantially higher than previously reported, and/or your expenses for primary custody have significantly risen, you can request that the amount of support be increased. Our job at the Law Offices of Douglas B. Warlick is to file a petition, because the change can only occur after it is filed, and then ensure that your rights are protected and your concerns heard by the court.
Alimony/Spousal Maintenance
Maintenance or spousal support granted in the initial divorce decree often can be modified for the same reasons listed above, subject to many statutory limitations, such as the form of maintenance granted. If you believe an ex-spouse no longer requires maintenance, you can petition for a termination of alimony. Likewise, if the former spouse’s income has risen significantly, we can represent you in arguing for an increase in monthly support.
Custody and Visitation
Work schedules and the needs of children change over time. If the current custody and visitation plan is not working, or if you feel you are being denied access to your children, Doug Warlick is a tireless advocate who strives to assure your legal rights are met by revisiting the custody agreement in court. The burden of proof is typically placed on the parent seeking the modification, and Mr. Warlick is a talented negotiator, court appointed GAL, certified mediator, and educator for the Kids Program who also has a reputation for honesty and fairness in the Kane County and DuPage County courts.
Removal (Relocation)
The court takes a hard look at any request to relocate out-of-state or to a distant part of Illinois. Removal of children is only granted if the relocating parent can prove that it is in the best interests of the child, and that the non-custodial parent will not be unduly restricted from visitation and joint decision-making. It is critical to have a qualified and experienced attorney to represent you in a removal petition.
